The Importer of Record is the party who is responsible for compliance and fees/duties/taxes for the product being imported to the US. This can be an owner (seller or buyer) or in some cases, a third party who assumes responsibility for the products.
To determine whether a third party can be listed as the Importer of Record, operators will need to contact US Customs and Border Protection directly, or consult with a Customs Broker.
The Importer of Record should be listed as the "Recipient" on your NOP Import Certificate.
Operators should be aware that the Importer of Record is required, under the USDA's SOE, to have organic certification under NOP (US National Organic Program). COR (Canada Organic Regime) certification under the US-Canada Organic Equivalency Arrangement does not allow Canadian COR-Accredited Certification Bodies to provide oversight of import activities in the US.
